Welcome to Myosin. These Terms of Service (the “Terms”) govern your access to and use of the Myosin mobile application and related services (collectively, the “Service”). By accessing or using Myosin you agree to be bound by these Terms.
Please read these Terms carefully. If you do not agree, you may not use the Service. Nothing in these Terms limits the mandatory consumer rights that consumer protection laws of your jurisdiction grant you (including Argentine Consumer Defense Law 24.240).
The Service is currently offered free of charge. If we add paid features in the future, applicable economic terms will be published before contracting.
We may suspend or cancel your account for violation of these Terms, security risks, or judicial/regulatory orders, generally with prior notice and an opportunity to cure when reasonably possible.
You retain all rights to your workout data, custom exercises, routines, habits, measurements and notes. You grant Myosin a limited, non-exclusive, royalty-free, revocable license to store, process, sync and display your content solely to provide the Service. This license does not include commercial exploitation, sale to third parties, or training AI models on your identifiable personal data.
Myosin and all associated content (design, exercise database, graphics, logos, source code) are our property and protected by IP laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use Myosin for personal, non-commercial use under these Terms. Open source attributions are available in-app under Profile → Settings → About.
Important Health Disclaimer
Myosin provides exercise-related information, tools and resources for informational and personal-tracking purposes only. It does not constitute medical advice, diagnosis, treatment, nor does it replace consultation with qualified healthcare professionals.
Before starting any exercise program or change to your physical routine, consult a physician — especially if you have pre-existing conditions, injuries, cardiovascular risk factors, are pregnant, or have any doubts about your physical capacity.
If you experience pain, dizziness, shortness of breath or any abnormal symptom during exercise, stop immediately and consult a professional. Use of Myosin is at your own risk.
The Service is provided “as is” and “as available.” We do not guarantee uninterrupted or error-free operation or specific fitness results. Nothing here excludes mandatory consumer warranties under applicable law (including Argentine Law 24.240).
To the maximum extent permitted by applicable law, and without prejudice to mandatory consumer rights, Myosin and its operators shall not be liable for indirect, incidental, special, consequential or punitive damages arising from use or inability to use the Service.
This limitation does NOT apply to:
Any clause that would transfer manifestly disproportionate economic risk to the consumer or waive non-waivable rights shall be deemed not written, pursuant to art. 37 of Argentine Law 24.240.
We may modify these Terms. For material changes we will provide at least 30 days' prior notice via in-app notice, email and an updated “Last Updated” date. If you disagree, you may reject the changes by deleting your account before they take effect.
Myosin may integrate with third-party services (Apple Sign In, Google Sign In, app stores). We are not responsible for their content, privacy practices or availability.
Myosin is currently free. If subscriptions or in-app purchases are introduced, billing will be processed through Apple App Store or Google Play Store, governed by the economic terms published at contracting and the relevant store terms. Cancellation is managed through your store account. Consumer withdrawal rights under art. 34 of Argentine Law 24.240 and equivalent laws will be honored.
The Spanish version of these Terms is the controlling version for all legal purposes. Translations to other languages (including this English version) are provided for convenience. In case of any discrepancy, the Spanish version prevails.
These Terms are governed by the laws of the Republic of Argentina.
Consumer forum: if you are a consumer under Law 24.240, you have the right to bring actions before the courts of your actual domicile or the place where the contract was entered into. This clause does not restrict any non-waivable forum granted by the mandatory law of your country of residence.
For non-consumer users, disputes will be submitted to the ordinary courts of the operator's domicile in Argentina.
These Terms together with the Privacy Policy form the entire agreement between you and Myosin.
Invalid provisions will be construed minimally to render them valid; remaining provisions remain in force.
Failure to enforce a right does not constitute a waiver.
You may not assign these Terms without our prior written consent. We may assign upon reorganization, merger, asset sale or similar transaction, with reasonable prior notice.
